Courageous Pastor, Kenneth Miller’s appeal to quash a Grand Jury subpoena, has been dismissed by the 2nd Circuit Court of Appeals in New York (as of yesterday, 3rd January,2013).
Pastor Miller’s legal team asked the Appeals Court to quash the Grand Jury subpoena issued by the District Court thereby preventing Ken’s Grand Jury deposition. They argued that forcing him to testify against his will and without an attorney present would violate his Constitutional protections to not incriminate himself and to have an attorney.
In dismissing Ken’s Appeal yesterday, the Court stated that “the Government promises sufficient protection of rights”.
Readers will remember that Pastor Miller helped a mother and child to flee the USA to protect the child from ending up in the custody of a lesbian.
